NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee(s) by that certain Deed of Trust dated February 11, 2003, executed by NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee(s) by that certain Deed of Trust dated February 11, 2003, executed by Deborah S. Michaux and Jules M. Michaux, II to D. Kevin Moffatt, Trustee, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 2943, at Page 961, which Deed of Trust was assigned by Mortgage Electronic Registration Systems, Inc. to The Huntington National Bank by ASSIGNMENT dated March 14, 2012, of record in the Clerk's Office in Book 235, at Page 814. Hereford & Riccardi, PLLC was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 28, 2012, of record in the Clerk's Office. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on: THURSDAY, MAY 3, 2012, AT 1:30 O'CLOCK P.M. All those certain lots, or parcels of land together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha City District, Kanawha County, West Virginia, being more particularly described as follows: PARCEL 1 All the following land situate in what is known as "Kanawha City" in the City of Charleston, Kanawha City District, Kanawha County, West Virginia, being Lots Nos. Eight (8), Nine (9), Ten (10) and Eleven (11), of Block One Hundred Fifty-Nine (159), as shown on the Revised Map of Kanawha City, a copy of which is filed and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book No.2, at pages Nos. 148 and 149, to which map reference is here made for a further and fuller description of the land hereby conveyed. This is the same property conveyed unto Deborah S. Michaux by deed dated July 19, 1993, of record in the Clerk's Office in Book 2320, at Page 382. PARCEL 2 All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, known and described as Lot No. 12 of Block No. 159 of Kanawha City, and addition to the City of Charleston, as shown on a map of same filed and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. This is the same property conveyed unto Deborah S. Michaux by deed dated July 19, 1993, of record in the Clerk's Office in Book 2320, at Page 384. TERMS OF SALE: 1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1. 3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6)The total purchase price is payable to the Trustee by cashier's check, cash or the equivalent within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale by cashier's check, cash or the equivalent.
